PHILADELPHIA, Sep 14, 2011 (BUSINESS WIRE) — The law firm of Berger & Montague, P.C. has filed a class action complaint in the United States District Court for the Eastern District of Michigan on behalf of all Michigan homeowners whose mortgage loans have been serviced by Saxon Mortgage Services, Inc. and/or Ocwen Loan Servicing, LLC (collectively “Defendants”), and who, since April 13, 2009, (1) have entered into a Trial Period Plan (“TPP”) contract with Defendants and made all payments as required by their TPP contract and complied with Defendants’ requests for documentation, and (2) have not received or have been denied a permanent Home Affordable Modification Agreement that complied with the U.S. Department of the Treasury’s Home Affordable Modification Program (“HAMP”) rules.
CR in Georgia said: “I have been working with my lender for well over a year trying to get my mortgage modified. Due to a serious illness, I have been unable to pay my mortgage. I sent in all required and asked for information in hopes of getting my loan modified. I kept getting turned down. This year I went to a NACA sponsored event in California and met with my lender. They informed me that the investor (Morgan Stanley) had me in a type of mortgage that allows no changes (modifications) to my loan.
JG in Florida asks “Is there anything that can be done about Saxon Mortgage, who is taking everbody property unlawful with out consideration. I too is in the same grip of lies. So there should be help somewhere, the modification plan is beginng is becoming a bad joke on society because of mishandling an misleading of this company.”
Janet in Virginia said: “I am joining the forces against Saxon Mortgage. We have been in a living nightmare dealing with this company. In August of 2008 we were notified by our Tax Accountant that we were not the legal note holder on our home. What a shock to us.
