Saxon Mortgage Services allegedly sued in Pennsylvania

TB said: “Yes, Saxon is currently being sued through an attorney’s office out of Pennsylvania. They are moving pretty quick about it too. All researched and proved to be legit. Also recommend keeping copies of the timeline and any correspondences with the company. (dates, times, names, etc) I’ve been keeping records since November. Just after receiving our Act 91, THEN our loan mod proposal two days later. Forward it all to your states attorney general.”

A recent email from the Law offices of Craig Hosay
    Dear Sirs and Madams:

Thank you for contacting our office or the office of Derrick Howard, Esq. regarding the potential class action suit against Saxon Mortgage Company. We are currently still in the process of actively assessing the viability of the case. We anticipate moving forward with filing suit in the near future, and will send periodic updates as to the progress of the suit. If you no longer wish to be included in the suit, please reply to this email and ask that your name be taken off our list of potential class members.

Please be aware that this correspondence is not an acceptance of your case. You will be asked to sign a Contingency Fee Agreement if your case is accepted by our office in any potential class action suit. Please be aware that your claim is subject to a Statute of Limitations, which may forever bar suit on the claim after the period of time indicated by law.

If you have any questions, please contact my office.

    Respectfully,

    Craig Hosay, Esq.

To avoid misunderstanding, please be advised that the law office of Craig Hosay has not yet filed a class action suit, as indicated in a previous post. Although the office is still reviewing data to assess the viability of any legal action, a suit has not been filed at this time.

You are receiving this correspondence because you have expressed interest in joining a potential class action lawsuit against Saxon Mortgage Company.

Please be advised that after numerous consultations with attorneys, we have concluded that, based upon the variety of potential claims, the Law Offices of Craig Hosay is unable to pursue a class action suit against Saxon Mortgage Company.

This is not an evaluation of your particular case. If you have not done so already, you should consult a local attorney regarding your options under your state’s law as well as any applicable federal law.

Please be advised that any claims you may have are subject to a Statute of Limitations which may forever ban your claim if not timely pursued. The length of the Statute of Limitations applicable to your potential claims may vary from that applicable to others’ claims, as they are based upon your specific claims as well as your state’s law. We therefore cannot say what the period applicable to your claims may be. You should contact a local attorney for help in determining the time remaining in which you may pursue any claims you have.

If you have any questions, please contact me at the above information.

    Respectfully,

    Craig Hosay, Esq

Help!!! I have been forced into Bankruptcy because Saxon has contacted an Attorney and are going to Foreclose. The funny thing is, I have proof through bank statements, that all of my payments have been made. As for the loan modification program, they never will return a call. The information they request and you fax in is going off into the wild blue yonder, never to be looked at again!
