Indeed many mortgages are placing homeowners in jeopardy. After watching a special on CNBC about this crisis it is hard to tell what investors are thinking. Foreclosures have leveled off in June but only because banks are already holding inventory from the market.

I to am having the same problem with saxon. i never get the same answer cant talk to the person handling my acct. Applied for a loan modification got no answer. was over charged ny 4200 dollars on my escrow and recieved a letter saying it would be refunded. Now im told it will not be refunded and not put toward the loan. When asked what will happen will that money owed to me im told the dont have the answer to that. I ask to be connected to the escrow dept im told they dont have a phone number and i cant talk to them. What do you do to save your home. All they want to do is short sale are home. The even signed are home up for a short sale even though we told them that we didnt want to do this.
After reading through numerous forums and seeing all the complaints against the fraudulent actions Saxon Mortgage has taken, I think a conglomerate lawsuit might be something we should ALL look into.
Last year my family looked into the remodification program that was government funded. We did this due to the fall in economy; we own a small used car dealership, which was probably one of the worse industries to be in at the time. So we hoped that in doing a remod and lowering our mortgage would give us hope to recoup from the fall in economy. Prior to looking into it, we were NEVER late a mortgage payment.
We discussed the process with Saxon which proposed this to be a some what of an easy process to start, after giving them all the necessary documents they requested they proceeded to ask us for the documents again, and again, and again. Saying either they were missing some or there was information missing on them. Which was a lie, but that’s not the worst of it. After multiple representatives agreeing we had all the proper documents in, they said it was going to be delayed because the government has not released funds yet….? So why would they start a program they weren’t even adequately set up to do in the first place?
Now, after 16months! Saxon is trying to claim we were late a payment and therefore do not qualify and we need to pay back the debt accumulated throughout the “trial” period, which was only supposed to be a three month process. To our acknowledgement we were ALWAYS ahead a month. We tried disputing personally and proving them documents justifying our claim, requesting conversation transcripts which stated we were on time and ok with the payments and documents, but miraculously the recorded conversations started disappearing and the only answer Saxon had was that our home, that houses two families and children under 7, was going up for auction in 30 days. Mind you the only indications Saxon made to inform us of this was via phone conversation, no notice in the mail, in person, or any other documentation. Just a phone call.
The story goes on and each day it’s getting more colorful, we’ve hired a remodification third party attorney, bankruptcy lawyer, and are now going forth with hiring an attorney equipped to handle a lawsuit against Saxon. I’ve had it with their scams and according to the abundant amount of stories on all the forums I’ve come across with claims against Saxon, it seems like the majority of all of us are fed up.
So, if you’d like to jump on board I’m prepared to use all resources I have and not only get the attention of Saxon, end their unethical, immoral wrongful doings.
